What does a machine tool need to be placed into the European Community market?

Some types of machineries with a very high hazard level for the user, are collected in Annex IV of the Machinery Directive and can be CE marked by the authorised representative established in the Community independently, only if there is a harmonized product standard and if it is fully respected. In other cases, the authorised representative must contact a notified body to compensate for the lack of precise information.

Each machinery must be completely defined from the health and safety point of view, and the authorised representative has to prepare the technical file to demonstrate that the machinery complies with the requirements of this Directive.

 

What the technical file of a machine tool is composed of?

The technical file shall comprise the following:

Failure to present the technical file in response to a duly reasoned request by the competent national authorities may constitute sufficient grounds for doubting the conformity of the machine tool with the essential health and safety requirements.

Therefore, if a non-European subject supplies a CE marked product, that mark is always illegal, even if the product complies with European laws. It is necessary to distinguish between the product, which enters the EU market, and the producer, if it is outside the EU, the law demands a substitute (importer or agent).
