What does a ‘toy’ need to be placed into the European Community market?

To carry out the CE marking of toys, the European law requires the preparation of the technical file that includes the risk analysis, the use and maintenance manual, the Declaration of Conformity, etc.

In toys, it is important to define the age group for which they are intended, which must be clearly indicated on the product. They can be of any shape and material, mechanical, electrical, chemical, in any case they must meet the priority requirement: they must be non-hazardous.

Based on the characteristics of the product, in many cases it is recommended to have tests performed by a specialized laboratory and/or a notified body. Some materials cannot be used to produce toys, while in other cases they can only be used in minimal percentage.

Certificates and test reports are an integral part of the CE marking of toys but do not replace it. In other cases, certificates from a notified body are mandatory. They must be attached as a part of the CE marking of toys but must never be delivered.

Failure to present the technical file in response to a duly reasoned request by the competent national authorities may constitute sufficient grounds for doubting the conformity of the toy with the essential health and safety requirements.
